Terms of Service
By using the Sparkdemy website or connecting a Facebook Page or Instagram professional account, you agree to these terms. A signed service agreement takes priority where it differs from these public terms.
Last updated: 30 August 2026
01
Eligibility and authority
- You must be at least 18 and authorised to accept these terms for the relevant company.
- You may connect only Facebook Pages and Instagram Business or Creator accounts that you are authorised to manage.
- You authorise Sparkdemy to receive messages, manage webhook subscriptions and send approved replies only as needed to provide the service.
02
The service
- The service can receive customer messages, generate AI drafts from approved knowledge, and route them for human approval or automatic reply according to your settings.
- Not every message category is suitable for automation; new knowledge categories require human approval by default.
- Features, usage, support and fees are governed by your plan, quotation or service agreement.
03
AI replies and client responsibility
- AI drafts can be incomplete, outdated or wrong. You are responsible for approving automatic-reply categories, keeping knowledge accurate and monitoring results.
- Payments, refunds, legal liability, medical matters, safety, complaints and other high-risk decisions should be handled by suitably qualified people.
- You are responsible for giving required notices to your customers and ensuring that conversation data and reply content are used lawfully.
04
Meta platform rules
- You must follow the applicable Meta, Facebook and Instagram terms, policies, messaging windows and permission requirements.
- Standard customer-service replies are subject to Meta's messaging window; an expired draft may not be sent.
- If Meta changes an API, withdraws permission, restricts an account or discontinues a service, the affected feature may be suspended or changed.
05
Prohibited use
- Do not use the service for spam, fraud, impersonation, harassment, discrimination, unlawful surveillance or other illegal activity.
- Do not bypass platform restrictions, access accounts without authority, or upload data you have no right to use.
- Do not use the service to make regulated professional decisions without appropriate human review.
06
Accounts, security and suspension
- Protect login details, authorise only appropriate staff and promptly notify us of suspected unauthorised access.
- You may disconnect a Meta account at any time; new messages will stop being collected after disconnection.
- We may restrict or suspend service for security risk, non-payment, breach of these terms or a platform requirement.
07
Availability and liability
- We take reasonable care in operating the service, but do not promise uninterrupted availability, continued third-party platform access or error-free AI output.
- To the fullest extent permitted by law, Sparkdemy is not liable for indirect, incidental or consequential loss.
- Without a separate signed service agreement, our total liability for the affected service is limited to the fees actually paid for that service during the three months before the event.
08
Changes and governing law
- We may update these terms for service, legal or platform changes. We will update the date and notify clients of material changes where appropriate.
- These terms are governed by the laws of the Hong Kong Special Administrative Region and subject to the non-exclusive jurisdiction of its courts.
